Terms of Use / Terms of Service¶

Acceptance by use: Using the platform constitutes acceptance of these Terms and the related Privacy and Cookie policies. That includes accessing or using Akashic (website, docs, admin, APIs, or hosted MCP memory services), creating an account, connecting an MCP client, or continuing after notice of updates. If you do not agree, do not use the Service.
Eligibility and accounts¶
Capable of forming a contract; Service not directed to children under 13; you safeguard credentials and MCP tokens; accurate registration information required.
The Service¶
Hosted persistent memory / contextual database features for AI agents and humans. Features may change. Provided “as available.” No guarantee of uninterrupted or error-free operation. Optional commercial agreements may add terms; unpaid use remains under these Terms.
Acceptable use¶
No unlawful content; no unauthorized access, scanning, or attacks; no disruption/abuse; no credential sharing that breaks isolation; no circumvention of security. We may suspend or terminate for violations or risk.
Customer Content and MCP responsibility¶
You retain rights in content you lawfully own. You grant Akashic a license to host, process, back up, encrypt, embed, index, and display Customer Content to operate the Service. You are solely responsible for content submitted by you or agents (including LLM MCP clients). You must have lawful rights/bases to store it. Exports/backups you create are your responsibility to secure.
Intellectual property¶
Service software, branding, and docs remain Akashic/licensor property. Feedback may be used without obligation.
Third-party services¶
IDEs, LLM hosts, OAuth, analytics, and monitoring have their own terms. Akashic is not responsible for their outages or model outputs.
Disclaimers¶
TO THE MAXIMUM EXTENT PERMITTED BY LAW: “AS IS” / “AS AVAILABLE”; no warranties of merchantability, fitness for a particular purpose, or non-infringement; no warranty that memories/embeddings are complete or suitable for safety-critical or regulated uses without your controls.
Limitation of liability¶
TO THE MAXIMUM EXTENT PERMITTED BY LAW: no indirect/special/consequential damages; aggregate liability capped at the greater of amounts paid to Akashic in the prior 12 months or US $100 if no fees paid. Mandatory non-excludable liability remains.
Indemnity¶
You indemnify Akashic against claims arising from your Customer Content, use, or Terms/law violations (except Akashic willful misconduct).
Suspension and termination¶
You may stop anytime. We may suspend/terminate for breach, risk, or discontinuation. Surviving clauses include IP, disclaimers, liability, indemnity.
Changes¶
Updated Terms take effect when posted; continued use is acceptance.
Governing law¶
Governing law/venue deferred for counsel confirmation based on operator establishment and non-waivable consumer rights. Interim: good-faith resolution via contact channels.
